The Service
Zoho RetailIQ offers a tailored service that helps retailers manage their operations, engage customers, and drive growth more effectively. Zoho RetailIQ provides various features such as customer relationship management, surveys, campaigns, and marketing automation.
Access to Other Zoho Services
Many Zoho services are integrated with Zoho RetailIQ. Your Zoho account will also allow you to access all Zoho services even if such Zoho services are not integrated with Zoho RetailIQ. Use of some of these Zoho services may require acceptance of terms of service specific to such Zoho services. You must read, understand, and accept the relevant terms before using the corresponding Zoho service.
Technical Support
We provide technical support to help diagnose and resolve any bugs or issues with the service. Support will be provided in accordance with the Service Level Agreements (SLAs) and the support plans the customer has subscribed to. For additional information, you can refer to our Support Policy available here. Customers are responsible for ensuring their users are adequately trained and possess the necessary skills to use the service. Our technical support services are limited to addressing issues related to the standard use of the service. Zoho is not responsible for providing support for custom development, specific customizations, or business processes.
Prescription Medicines and Other Regulated Items
If you use Zoho RetailIQ to promote prescription medicines or other regulated items, you must hold all required licenses and comply with all applicable laws, regulations, and industry guidelines. This includes, but is not limited to, ensuring that all marketing materials, offers, and loyalty programs are truthful, accurate, and legally permissible. You understand we do not verify, endorse, or take responsibility for any claims you make, products you offer, or content you provide. You assume full responsibility for ensuring the legality and compliance of your activities, and you will indemnify and hold us harmless from any claims or liabilities arising from your marketing or sale of prescription medicines or regulated items.
Restrictions on Use
In addition to all other applicable terms and conditions, you agree that you will:
- not collect, post, transmit, or publish information that violates any applicable local, state, national or international laws.
- not publish dangerous, harmful, or misleading information.
- not impersonate any person or entity to gather information.
- not collect information from minors without verifiable parental or guardian consent.
- not collect credit card, debit card, bank account related information or login credentials.
- not engage in any activities related to cryptocurrency, including but not limited to initial coin offerings, cryptocurrency mining, or wallet services.
- not post, transmit, or publish obscene, pornographic, or otherwise inappropriate content.
- not post, transmit, or publish content that is unlawful, hateful, or promotes racism, discrimination, or hatred based on ethnicity.
Data Collection and Compliance
Zoho RetailIQ enables you to collect, analyze, and organize data about your prospects, customers, and website visitors and create personalized marketing campaigns. In certain jurisdictions, data collection and use may be subject to regulations that require you to provide notice to individuals or obtain their consent. You acknowledge and agree that it is solely your responsibility to comply with all applicable laws, including but not limited to providing appropriate notice and obtaining consent when necessary. Zoho is not responsible for your compliance with these regulations or for any legal obligations arising from your data collection and marketing activities.
Usage Limits for Zoho RetailIQ
Zoho may prescribe usage limits including API usage limits based on the subscription plan chosen by you. You must make sure that your usage is within the usage limits prescribed by Zoho in order to avail uninterrupted service. You understand that Zoho may restrict an activity if you reach the usage limit corresponding to such activity.
Usage of SMS functionality
To use the features that enable you to send SMS, you may be required to obtain a sender ID and have your content pre-approved by the telecom providers that assist us with provision of the functionality.
When you use Zoho RetailIQ to send promotional communicaions via SMS, you shall ensure that:
- You have explicit and demonstratable consent from recipients before sending promotional communications, or that you have a pre-existing relationship with the recipients and they reasonably expect to receive such communication from you.
- Each communication clearly identifies you as the sender and includes an option for recipients to opt out of future communications. You must honor all opt-out requests promptly.
- All communications are in compliance with applicable laws in your jurisdiction.
- You do not send any communications to contacts that are scraped, bought, or received from third parties. However, you may send communications to contacts referred to you by your existing customers.
- You will not exceed any applicable bandwidth limits, place an excessive burden on our service, or engage in any activities that disrupt the service for others.
You understand and agree that:
- Zoho may monitor, review and throttle the content of communications sent through Zoho RetailIQ to ensure safety, security, and compliance with applicable laws and these terms.
- If we receive complaint(s) about your use of Zoho RetailIQ or determine, at our sole discretion, that you have violated applicable laws or these terms, we may take appropriate actions against you. This may include suspending or terminating your access to SMS functionality or your account, in which case you will not be entitled to any refunds.
DNT Header
Do Not Track (DNT) is an HTTP header field that enables users to opt out of tracking by websites they have not visited. You understand that Zoho RetailIQ does not honour DNT header because of the fact that it is not approved by w3c standards.
Zoho RetailIQ Embed Code
Zoho RetailIQ Embed Code is the code that is installed on your website for the purpose of collecting visitor details ("Embed Code"). Subject to these Terms, (a) Zoho grants you a limited, revocable, non-exclusive, non-transferrable, non-sub licensable license to install copy and use the Embed Code solely as necessary for you to use Zoho RetailIQ on your website. You will not (and you will not allow any third party to) (i) copy, modify, adapt, translate or otherwise create derivative works of the Embed Code or the documentation; (ii) reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Embed Code, except as expressly permitted by the law in effect in the jurisdiction in which you are located; (iii) rent, lease, sell, assign or otherwise transfer rights in or to the Embed Code and the documentation; (iv) remove any proprietary notices or labels on the Embed Code; or (v) use, post, transmit or introduce any software which interferes or attempts to interfere with the operation of the Embed Code.
Violations
You understand and agree that Zoho may screen the content or otherwise monitor your usage of Zoho RetailIQ to ascertain if you have used Zoho RetailIQ in violation of these Terms. If your use of Zoho RetailIQ is found to be in violation of these Terms, Zoho may, in its sole discretion, take appropriate actions against you, which may include suspension and permanent termination of your user account.
Modification of Terms of Use
Zoho reserves the right to modify these Terms. Modifications to these Terms are effective upon your use of Zoho RetailIQ subsequent to publication of such modification.
