E-signature legality in Saudi Arabia

Saudi Arabia's legal system follows traditional Islamic law, Shariah. This means contracts are generally valid as long as all parties consent to the agreement, whether it’s made verbally, in writing, or electronically. A handwritten signature isn’t always required by mandate. However, if a dispute arises and the agreement needs to be proven in court, having court-admissible evidence, such as an electronic signature, can be very helpful.

Electronic signatures have been legally recognized in Saudi Arabia since the enactment of the Electronic Transactions Law (Royal Decree No. M/18) in 2007 and the implementing regulations of the electronic transactions system (No. 1/1429) in 2008. Article 5 of the Electronic Transactions Law stipulates that electronic transactions, records, and signatures are completely legal and enforceable. They cannot be questioned or challenged solely because they were conducted electronically.

Zoho Sign's integration with emdha

emdha is a trust service provider based in Saudi Arabia, operating under the Saudi National Root CA. It is licensed by Saudi Arabia's Communications, Space, and Technology Commission (CST), regulated by the Digital Government Authority (DGA), and holds certification from WebTrust for Certification Authorities.

The integration between Zoho Sign and emdha is pretty straightforward. To leverage this integration, you must register for the Nafath app and verify your identity using your national ID or Iqama ID. When signing documents via this integration, Zoho Sign sends a push notification through emdha to your Nafath app. Simply open the Nafath app, choose the number displayed on Zoho Sign, and enter your personal PIN to complete the signing process. It's as easy as that!
