The legal landscape of e-signatures in Mexico
Mexico doesn't have a dedicated law that explicitly governs electronic signatures and digital data. The Code of Commerce and the Federal Civil Code serve as the primary legal frameworks for the validity and enforcement of electronic signatures and digital transactions. According to these laws, electronic signatures have the same legal standing as traditional handwritten signatures. This means they cannot be deemed invalid or refused just because they're electronic. In addition, all methods of creating electronic signatures are equally recognized, with no limitations or exceptions to their legal validity.
Understanding NOM 151 certificates
NOM 151 is an Official Mexican Standard that sets the framework for the conservation of data messages and the digitization of documents. It also defines the essential characteristics required for data retention certificates, which are used to validate electronically signed documents. These certificates, known as NOM 151 certificates, ensure the authenticity, integrity, and legal compliance of electronic records under Mexican law. They're issued by certification service providers accredited by the Mexican Ministry of Economy.
NOM 151 certification via PSC World in Zoho Sign
When a document is signed with the PSC World integration enabled in Zoho Sign, the document’s hash is sent to PSC World, which generates a timestamp certificate. This certificate is securely stored in Zoho Sign alongside the document’s original hash, serving as proof that the document remains unaltered.
To verify a document’s integrity, simply download the NOM 151 certificate from the document details view in Zoho Sign and validate it on PSC World’s official website.
